Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE, IF AVAILABLE, WILL NOT INCREASE THE CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THE FOLLOWING SWEEPSTAKES IS OFFERED IN THE UNITED STATES AND UNDER THESE OFFICIAL RULES AND SHALL ONLY BE CONSTRUED, GOVERNED, AND EVALUATED ACCORDING TO THE LAWS OF THE UNITED STATES.

There will be an opportunity for one lucky attendee to win a $500 USD Airbnb gift card (“Giveaway”) at LaunchDarkly‘s Galaxy 2024 Conference, May 21-22, 2024 (the “Event”), sponsored by Catamorphic Co. dba LaunchDarkly (“Sponsor”). The winner will be announced during a break between activities and will be chosen at random from a list of May 21, 2024 attendees present at the Event (each an “Entrant”). By participating in this Giveaway, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the overall administration of the Giveaway. Entrants should look solely to Sponsor with any questions, comments or problems related to the Giveaway. Sponsor’s computer will be the official clock of the Giveaway.

Eligibility: Open to Event attendees who are: (A) at least 18 years of age or the legal age of majority, whichever is older, in their jurisdiction of residence; (B) registered for the full conference Event pass and physically present at the time the winner is announced. Individuals in the following categories are not eligible to participate or win the Prize: (1) Developer Day Attendee only registrants (2) employees, contractors, consultants, officers, directors, and agents (and their immediate families and household members, regardless of where they live), or members of the same households, whether related or not, of Sponsor, its parent, divisions, subsidiaries, agents, promotional partners, advertising/promotion agencies, and prize suppliers (3) employees, officers, or officials of any government entity, including, but not limited to, any person acting in an official capacity for or on behalf of any national, state, provincial or local government, or any department or agency thereof; (4) employees of any company that has a policy against and/or legally prohibits participation in the Giveaway or the awarding of a prize/award to an employee; (5) an individual on the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons List or otherwise under sanction by OFAC (or an immediate family member (spouse, parent, child, sibling, grandparent, or stepchild, wherever they may live) of such an individual) or employed by or affiliated with an entity sanctioned by OFAC; or (6) a resident of the province of Quebec, Canada, the country of Australia, Belgium, Brazil, China, Croatia, Denmark, Egypt, Italy, France, Germany, Hungary, Lebanon, Lithuania, Luxembourg, Mexico, Saudi Arabia, Thailand, Turkey, Romania, or any country under U.S. embargo during Event or at the time of drawing.

Prize and Prize Value: One random Entrant will receive a $500.00 USD gift card to Airbnb.com and the prize will be given directly to the winner at the Event. In no event will the Sponsor award more prizes than are provided for in these Official Rules. Prize cannot be transferred, redeemed for cash or substituted by the winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the prize represents Sponsor's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the Prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor will not replace any lost or stolen prize items. Winner is solely responsible for any local, provincial, state, federal or any other applicable taxes, and any other costs, expenses and fees connected with the prize. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and Sponsor may, in its sole discretion, select an alternative potential winner. All other expenses not specified herein are the responsibility of the winner.

Winner Notification And Announcement: Sponsor will randomly select a winner from among all eligible entries during the Event. The potential winner will be selected on May 21, 2024 and will be notified by text or phone call to the mobile telephone number provided when signing up to register for the Event. Sponsor will not be liable for any prize notification that is lost, intercepted,or not received by any potential winner for any reason. The potential winner must be physically present and must come to the main LaunchDarkly booth within half an hour of notification to claim the prize. If for any reason the potential winner from the first drawing is ineligible to win, fails to claim, or declines to receive a prize, Sponsor will randomly select, from among all eligible entries, up to two (2) additional names of a potential winner of the unawarded prize. In order to receive a prize, the winner may be required to sign a Declaration of Eligibility, Liability and Publicity Release (unless prohibited by law).

Odds Of Winning: Odds of winning will depend on the number of valid entries received during the Event.

Release/Disclaimer of Liability: By participating, Entrants agree (a) to abide by and be bound by these rules and decisions of Sponsor which shall be final in all respects relating to the Giveaway, including without limitation the interpretation of these rules; (b) to release, discharge and hold harmless Sponsor, its subsidiaries, affiliates, advertising agencies, promotional agencies and any other individual or company involved in the development or execution of the Giveaway (the “Released Parties”) from any and all injuries, liability, losses, damages, rights, claims and actions of any kind resulting from their participation in the Giveaway or their acceptance, use or misuse of a prize; and if a winner; (c) to the use of his/her name, voice, image and/or likenesses for advertising, publicity and promotional purposes without further compensation (unless prohibited by law) and to execute specific consent to such use if asked to do so. Entrants who provide false information, or information that is incomplete, inaccurate or are otherwise forged, defective, or made outside authorized channels, shall be void. Released Parties are not responsible and shall not be liable for: (a) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any error (human or otherwise) which may occur in the processing of entries; (b) failed, incomplete, garbled or delayed computer transmissions; (c) entries which are late, misdirected, unintelligible, garbled or incomplete, or are not recorded or cannot be completed for any reason; (d) late, lost, misdirected, mutilated, incomplete or illegible entries or postage-due mail; or (e) any condition caused by events that may cause the Giveaway to be disrupted. If for any reason the Giveaway is not capable of running as planned, Sponsor reserves the right at its sole discretion to immediately cancel, terminate, modify or suspend the Giveaway.

Conduct and Decisions: All decisions of the Sponsor will be final and binding on all matters relating to this Giveaway. Persons who violate any rule, gain unfair advantage in participating in the Giveaway, or obtain winner status using fraudulent means will be disqualified. The Sponsor will interpret these Official Rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Giveaway and the Sponsor’s decisions concerning such disputes shall be final.

Disputes: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Giveaway are hereby excluded, and any Entrant expressly waives any and all such rights. Entrants agree that these Official Rules and the Giveaway are governed by the laws of California, USA, without regard for conflicts of law doctrine of any jurisdiction. The parties specifically disclaim the UN Convention on Contracts for the International Sale of Goods. Entrants hereby waive all rights to (i) claim or be awarded any punitive, direct, indirect, incidental, and consequential damages and any other damages, and (ii) to have damages multiplied or otherwise increased, including for willful patent infringement.

Privacy: Any information submitted as part of the Event will be treated in accordance with the Sponsor’s Privacy Policy located at https://launchdarkly.com/policies/privacy/. Sponsor may use and share an Entrant’s personal data with third parties to the extent necessary to fulfill its obligation to administer and sponsor this Giveaway.

Severability: If any provision of these Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official Rules and shall not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Official Rules solely for convenience of reference and shall not be deeded to affect in any manner the meaning or intent of these Official Rules or any provision thereof.

Giveaway Results: To receive the name, city and state of the winner, you can send an email to events@launchdarkly.com with the subject, “Galaxy Gift Giveaway 2024 In Person Giveaway”. Requests must be received within four (4) weeks of the end of the Event.
