Product-Specific Terms
Effective September 8, 2025
These Product-Specific Terms ("Product-Specific Terms") apply to the Services below and supplement and form part of your Agreement governing the purchase of Services between you and LaunchDarkly (the “Agreement”). If there is any conflict between the Product-Specific Terms and the Agreement, the Product-Specific Terms will prevail. Capitalized terms used and not defined in the Product-Specific Terms have the meanings given to them in the Agreement.
Session Replay
1. “Session Replay” means LaunchDarkly’s session replay offering, which includes software, tools and applications that enable Customers to understand how visitors or Customer’s users interact with Customer’s websites and applications.
2. Customer may only use Session Replay on sites and for applications that Customer has the express permission to do so, or that are otherwise owned or controlled by Customer.
3. Customer shall, and represents and warrants that it does, clearly disclose its use of the Session Replay to its relevant end users, by contract or other written means, including in relation to any processing of Personal Data conducted via Session Replay.
4. Customer shall, if required under Data Privacy Laws, obtain unambiguous, specific, freely given, informed and revocable consent from the relevant end users whose Personal Data is processed via Session Replay.
AI Features
1. “AI Features” means features or functionalities in the Services accessed by Customer that are based on artificial intelligence, machine learning, or similar technologies. Customer may provide or make available prompts, information, other content or materials to AI Features (“Input”), and receive results generated and returned by AI Features based on that Input (“Output”.)
2. LaunchDarkly AI Features
2.1 AI Features may be developed by LaunchDarkly or third-party providers and are available as part of the Services. These AI Terms only apply to AI Features provided by LaunchDarkly, not to third-party AI tools you may use separately.
3. Ownership. Input and Output are considered Customer Data. LaunchDarkly and its third-party providers own all rights in the AI Features themselves. You own your Input and Output, except that LaunchDarkly may use Input and Output as described in these Product-SpecificTerms.
4. Data Usage and Model Training. Information collected from Customer interactions with the Services may be used for product maintenance, improvement and support. Our third-party providers are prohibited from using Customer Data for their own model training. Customer may choose to opt-out of using AI Features (via Admin settings).
5. Customer Responsibilities
5.1 Customer is solely responsible for Inputs.
5.2 Customer may not use AI Features (a) to develop Customer’s own artificial intelligence products or services, or any machine learning models or technology; (b) to mislead anyone that an Output was solely human generated; (c) to infringe, misappropriate, or otherwise violate our or any third party’s intellectual property rights; (d) in violation of our Acceptable Use Policy; (e) to lead or cause bias or discrimination; or (f) to lead to errors, omissions or other risks that have the potential to impact safety, fundamental rights of natural persons or affect the safety of tangible or physical property.
5.3 To the extent Customer uses AI Features to process personal, regulated, or sensitive information, then Customer will comply with all applicable data privacy laws and regulations, including providing privacy notices and obtaining consent, where required.
5.4 Customer is responsible for reviewing, editing, and amending any Output before publishing, using, or relying on such Output. Due to the nature of artificial intelligence or machine learning technology, Output may not be unique and may generate the same or similar Output for other third parties.
6. Disclaimer: AI Features may generate unreliable, insecure, inaccurate, or offensive Output. LaunchDarkly makes no warranty or guarantee as to the accuracy, completeness, or reliability of Output and will in no way be liable or responsible for Customer’s use of Output or any omissions or errors in Output.
7. Miscellaneous: LaunchDarkly may update these Product-Specific Terms from time to time. These Product-Specific Terms will survive the expiration or termination of your Agreement.
