Code of Conduct

Effective as of October 11, 2024.

At LaunchDarkly, we strive to deliver exceptional feature flag management solutions while maintaining the highest standards of integrity, ethical behavior and operational excellence. In order to create an environment that furthers our values, the following Code of Conduct (“Code”) outlines the minimum standards and expectations that we expect our suppliers, contractors, agents, and other business partners (“Suppliers”) to uphold as a condition of working with LaunchDarkly. By adopting this Code, LaunchDarkly aims at minimizing legal, financial and reputation risks and promoting an environment that fosters trust and security for our customers and operations.

Legal and Ethical Compliance

Ethical Business Practices: Suppliers must conduct their business with integrity, honesty, and transparency. Any form of bribery, corruption, or other unethical behavior is strictly prohibited.

  • Anti-Corruption/Anti-Bribery: Bribery of any kind is never permitted at LaunchDarkly. LaunchDarkly is committed to conducting its business in compliance with all laws prohibiting bribery and other corrupt practices. Suppliers must comply with the U.S. Foreign Corrupt Practices Act, the UK Bribery Act, equivalent laws of Supplier’s jurisdiction, and all applicable anti-corruption regulations and international anti-corruption conventions. 
  • Conflicts of Interest: A “conflict of interest” occurs when personal or professional interests or activities interfere with, or appear to interfere with, the best interests of LaunchDarkly or Supplier. Suppliers are required to avoid conflicts of interests and situations that may appear to create an actual or potential conflict of interest. Suppliers should identify and disclose any actual or potential conflicts of interest or relationships with LaunchDarkly that may influence LaunchDarkly’s or Supplier’s business decisions.  
  • Fair business and antitrust: Suppliers are expected to comply with all applicable laws and regulations regarding fair competition, antitrust, unfair/deceptive trade practices and accurate and truthful advertising.
  • Export and Trade: Suppliers must comply with all applicable customs and import laws and respect international trade restrictions, international sanctions and all laws and regulations concerning export controls.

Compliance with Laws: In addition to the foregoing, Suppliers must comply with all other applicable laws, regulations, and other legal requirements in all applicable jurisdictions.

Labor, Employment and Human Rights

Humane Treatment: Suppliers shall provide their workers with a workplace free of harsh and inhumane treatment, including sexual harassment, sexual abuse, corporal punishment, bullying, mental or physical coercion, or verbal abuse of workers. In addition, threat of any such treatment is prohibited. Suppliers must treat all of their workforce with dignity and respect.

Non-Discrimination: LaunchDarkly is an equal opportunity employer. Suppliers may not engage in any discriminatory practices in hiring, compensation, access to training, promotion, termination, and/or retirement based on race, color, sex, national origin, religion, age, physical or mental disability, gender identity or expression, marital status, pregnancy, sexual orientation, political affiliation, union membership, veteran status, or any other protected class under applicable federal, state, or local laws. 

Workplace Safety: Each Supplier must comply with all applicable environmental, health and safety laws and regulations. Suppliers with remote teams must ensure that employees have access to a safe and secure working environment.

Fair Labor Practices: Each Supplier must comply with all applicable wage and hour laws and regulations, including those relating to minimum wage, overtime, and other elements of compensation, and must provide all legally mandated benefits.

Forced Labor/Human Trafficking: LaunchDarkly will not tolerate or condone human trafficking or slavery in any part of our company or supply chain. LaunchDarkly is committed to implementing and enforcing effective systems and controls to ensure modern slavery is not taking place anywhere in our business or in any of our supply chains. Suppliers are expected to hold their own suppliers to the same high standards. Suppliers must adhere to all applicable anti-modern slavery and human trafficking laws. Employment must be freely chosen.

Child Labor: No Supplier will employ or otherwise engage workers who are below the legal minimum age for employment under applicable local laws and regulations.

Freedom of Association and Collective Bargaining: Suppliers must respect the rights of workers to freely associate, join unions, seek representation, and engage in collective bargaining, consistent with applicable law and practice.

Confidentiality and Data Privacy

Confidentiality: Suppliers may not share, disclose or use LaunchDarkly’s intellectual property, confidential information, or any other proprietary or non-public information that the Supplier acquires through its relationship with LaunchDarkly unless permitted (1) in the applicable contract with LaunchDarkly, or 2) by express written consent by LaunchDarkly.

Data Privacy: Suppliers must comply with the contractual data privacy protections agreed with LaunchDarkly and all relevant data protection regulations such as GDPR, CCPA, or others applicable to the regions where services are provided.

Non-Retaliation and Reporting

Suppliers are encouraged to report any violations or suspected violations of this Code or other ethical questions or concerns.  Reports should be directed to the LaunchDarkly Legal Department at conduct@launchdarkly.com. If making an anonymous submission is preferred, please submit a report at https://launchdarkly.allvoices.co/. Once a report is received, LaunchDarkly will promptly investigate the report and respond accordingly. LaunchDarkly will not tolerate retaliation against anyone who reports violations or suspected violations, or cooperates with investigations.

Conclusion

LaunchDarkly is committed to ethical governance, responsible operational practices, and workforce safety in order to uphold our company values. By partnering with LaunchDarkly, Suppliers agree to adhere to the standards set forth in this Code of Conduct. As laws, regulations, industry standards and our business values and commitments evolve, LaunchDarkly reserves the right to review and update this Code to reflect these changes. We value and appreciate your commitment to these principles and look forward to a successful and ethical collaboration.
